Terms and Conditions for Waste Clearance Balham Services

These Terms and Conditions set out the basis on which Waste Clearance Balham provides waste clearance and rubbish removal services. By making a booking, accessing our services, or allowing our operatives onto your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any waste collection service.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business, company, landlord, tenant, or other organisation booking or receiving the waste clearance service.

We, us, our means Waste Clearance Balham, the provider of rubbish removal, junk clearance, and related waste services.

Services means any waste removal, rubbish collection, bulky item disposal, garden waste clearance, or similar service that we agree to perform.

Site or Premises means the address or location where the waste clearance service is to be carried out.

Waste means any items, goods, refuse, junk, rubble, furniture, appliances, green waste, or other materials that the Customer presents for collection and disposal.

2. Scope of Services

We provide on-site waste collection and clearance services within our service area. Our services typically include the loading, transportation, and lawful disposal or recycling of waste presented to us at the agreed location. We are not responsible for dismantling, disconnecting, or making safe any installations, fixtures, or utilities unless expressly agreed in writing in advance.

We reserve the right to refuse to collect any items that we reasonably believe are hazardous, illegal, excessively heavy or bulky for safe handling, contaminated, incorrectly stored, or not as described at the time of booking. Examples of items we may decline include, but are not limited to, asbestos, medical waste, certain chemicals, gas bottles, and materials requiring specialised permits or handling.

3. Booking Process

3.1 Bookings can be made by telephone, email, or any other method we make available. When making a booking, the Customer must provide accurate and complete information, including the description and approximate volume or weight of the waste, access conditions, and any relevant restrictions at the Site.

3.2 Any quotation given at the time of booking is based on the information supplied by the Customer. Our quotation may be revised if, upon arrival, the actual volume, weight, nature, or location of the waste differs from the information provided. In such cases, we will inform the Customer of any change in price before commencing work.

3.3 Bookings are subject to availability. We will use reasonable efforts to attend the Site on the agreed date and within the agreed time window, but time shall not be of the essence. We are not liable for any losses arising from delays due to traffic, weather, operational issues, access restrictions, or other factors beyond our reasonable control.

3.4 The Customer is responsible for ensuring that someone with the authority to confirm the work and authorise any additional charges is present at the Site at the time of collection, unless otherwise agreed in advance.

4. Access and Customer Obligations

4.1 The Customer must provide safe, reasonable, and lawful access to the Site and to the waste to be collected. This includes securing any necessary permissions from landlords, neighbours, managing agents, or local authorities where required.

4.2 The Customer must ensure that the waste is clearly identified and separated from items that are not to be removed. We shall not be liable for removing items that were not clearly distinguished from waste or for failing to remove items that were not properly identified.

4.3 If we are unable to carry out the Services due to lack of access, parking restrictions, unsafe conditions, or the absence of an authorised person to approve the work, we may charge a cancellation or call-out fee in accordance with these Terms.

4.4 Where our operatives are required to enter a building, garden, courtyard, or other part of the premises, the Customer is responsible for ensuring that the environment is safe, free of unreasonable hazards, and compliant with all health and safety requirements.

5. Prices and Quotations

5.1 Prices are generally based on the type and volume of waste collected, measured by the space it occupies in our vehicle, the weight of certain materials, or a combination of both. Additional charges may apply for heavy materials, difficult access, or specialist handling, which will be explained wherever possible in advance.

5.2 Any verbal or written quotation is an estimate only and is subject to confirmation on-site. If the actual waste differs from the description given, or if additional work is required to safely remove the waste, the final price may change. We will notify the Customer of any revised price before proceeding with the clearance.

5.3 All prices are stated in pounds sterling and may be subject to applicable taxes. The Customer will be informed of any such taxes at or before the time of booking.

6. Payment Terms

6.1 Payment is due in full upon completion of the service, unless we agree otherwise in writing before the service date. We may require a deposit or full prepayment for certain bookings, especially for larger clearances or commercial customers.

6.2 We accept payment by cash, card, bank transfer, or other methods that we make available. Where payment is made by card, the Customer authorises us to charge the agreed amount to their card upon completion of the service or at the time specified in any written agreement.

6.3 For approved account customers, invoices are payable within the agreed credit period. If no credit period is specified, payment is due within 14 days of the invoice date.

6.4 If the Customer fails to make any payment when due, we reserve the right to charge interest on the overdue amount at the statutory rate, as well as any reasonable costs incurred in recovering the debt, including legal fees and collection charges.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by notifying us by telephone or email. Where possible, we request at least 24 hours notice before the scheduled collection time.

7.2 If the Customer cancels the service with less than 24 hours notice, or if we attend the Site but are unable to carry out the service for reasons beyond our control, we may charge a cancellation or call-out fee to cover our reasonable costs, including travel and lost time.

7.3 If we need to cancel or reschedule a booking for operational reasons, we will inform the Customer as soon as reasonably practicable and offer an alternative date or time. Our liability in such cases will be limited to the rescheduling of the service or a refund of any sums paid in advance for the cancelled service.

8. Waste Handling and Regulations

8.1 We operate in accordance with relevant UK waste management legislation and regulations. We will transport and dispose of waste only at authorised facilities and will take reasonable steps to maximise recycling and recovery where practicable.

8.2 By using our services, the Customer confirms that they have the right to dispose of the items presented as waste. The Customer shall indemnify us against any claim, loss, or liability arising from the unlawful disposal of items for which they did not have the necessary rights or authority.

8.3 We cannot accept certain types of hazardous or controlled waste without prior arrangement and the appropriate documentation. Where such waste is discovered on arrival and has not been previously declared, we may refuse to collect it and may charge a reasonable fee for any attendance and waiting time already incurred.

8.4 Once waste has been loaded onto our vehicle and payment has been made or agreed, ownership of the waste transfers to us and the Customer has no further claim to it. This does not affect the Customer's obligations to provide accurate information about the nature of the waste.

9. Liability and Damage

9.1 We will take reasonable care when carrying out the Services. However, the Customer acknowledges that waste clearance can involve moving bulky, heavy, or awkward items through confined spaces and that there is a risk of minor scuffs, marks, or superficial damage to walls, floors, and fixtures.

9.2 We shall not be liable for minor cosmetic damage that occurs in the normal course of moving items, provided that we have exercised reasonable care and skill. If the Customer is concerned about particular surfaces or fixtures, they must notify us before work begins so that we can take extra precautions where reasonably possible.

9.3 Our total liability to the Customer in respect of any loss or damage arising from the Services, whether in contract, tort, or otherwise, shall be limited to the total price paid or payable for the relevant service, except where liability cannot lawfully be limited.

9.4 We shall not be liable for any indirect or consequential loss, including loss of profit, loss of business, loss of opportunity, or any similar damage, arising out of or in connection with the provision of the Services.

9.5 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

10. Customer Property and Personal Items

10.1 It is the Customer's responsibility to ensure that no personal items, documents, valuables, or items not intended for disposal are left in or among the waste to be collected. We are not responsible for checking bags, boxes, drawers, cupboards, or containers for such items.

10.2 We accept no liability for any loss or damage to personal or valuable items that are removed as waste if they were not clearly separated and marked as not for disposal before the service commenced.

11. Health and Safety

11.1 We operate in accordance with applicable health and safety laws. Our operatives may refuse to undertake any task or enter any area that they reasonably consider unsafe or likely to cause harm.

11.2 The Customer must inform us of any known hazards at the Site, including structural issues, exposed wiring, hazardous materials, aggressive animals, or any other risks that could affect the safe performance of the Services.

12. Complaints and Disputes

12.1 If the Customer is dissatisfied with any aspect of our service, they should contact us as soon as possible with full details of the issue. We will investigate the complaint and aim to resolve the matter promptly and fairly.

12.2 Where a dispute arises that cannot be resolved directly, both parties agree to consider mediation or another form of alternative dispute resolution before commencing legal proceedings, where this is appropriate and proportionate.

13. Changes to Terms and Conditions

13.1 We may update these Terms and Conditions from time to time to reflect changes in the law, our services, or business practices. The latest version will apply to all new bookings made after the date of publication.

13.2 The version of the Terms and Conditions in force at the time of the Customer's booking will apply to that booking, unless a change is required by law or is mutually agreed in writing.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided.

15. General Provisions

15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, that provision shall be treated as deleted, and the remaining provisions shall continue in full force and effect.

15.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.

15.3 The Customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations where this does not materially affect the standard of service provided.

15.4 These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between the Customer and Waste Clearance Balham in relation to the Services and supersede any prior discussions or understandings.
